Child Protection Legal Services FAQS

Murder & Manslaughter FAQS

What should I do if Child & Family Services (CFS) contacts me?

If you are contacted by CFS, it is important to seek legal advice as soon as possible. Early legal guidance can help protect your rights and clarify your options when dealing with CFS involvement.

Can Advocate Law help Indigenous families and governing bodies?

Our legal team supports Indigenous jurisdiction and is experienced in navigating the interaction between federal, provincial, and Indigenous law in child protection matters. We provide culturally sensitive representation that respects and acknowledges the unique rights of Indigenous children, families, and communities.

What happens during a CFS investigation?

During a Child & Family Services investigation, a caseworker will assess the situation by speaking with your family, gathering information, and determining if there are any safety concerns for your child. It’s important to cooperate while also knowing your rights, including the right to legal representation.

Can I refuse to let CFS into my home?

You have the right to ask CFS workers for identification and to understand the reason for their visit. While you may refuse entry, Child & Family Services may seek a court order if there are urgent concerns about your child's safety. Consulting a lawyer as soon as possible can help you understand your options.

What if my child is apprehended by child services?

If your child is taken into care by CFS, you are entitled to know the reasons, respond, and attend all legal proceedings. Given the court timelines, it is important to seek legal advice as soon as possible after your children are taken into care.

What if I can’t afford a lawyer?

We accept files on private retainers and through Legal Aid Alberta. If you cannot afford a lawyer, please find out if you qualify for Legal Aid. If you are a child or youth seeking a lawyer to represent yourself, contact the Office of the Child and Youth Advocate to have a lawyer appointed to represent you for free.
